1. Eligibility: The Baja or Bust Sweepstakes Promotion (the “Promotion”) is open only to individuals who (a) are legal residents of the United States, (b) are eighteen (18) years of age or older at the time of entry, and (c) are not currently residents of the states of New York, Florida, or Rhode Island. Employees of any of the sponsor companies, or of any company involved in the design, implementation, or promotion of the Promotion, as well as the immediate family (spouse, parents, siblings, and children) and household members of each such employee are not eligible. The Promotion is subject to federal, state, and local laws and regulations and is void where prohibited by law.

3. Agreement to Official Rules: Participation in the Promotion constitutes entrant’s full and unconditional agreement to and acceptance of these Official Rules and the decisions of the Sponsors, which are final and binding. Winning a prize is contingent upon fulfilling all requirements set forth herein.

4. Entry Periods: The Promotion begins on July 16, 2007 at 12:00:00 a.m. Eastern Time (“ET”) and ends on October 1st, 2007 at 11:59:59 p.m. ET (the “Promotion Period”). Entries submitted prior to or after the Promotion Period will be disqualified.

5. How to Enter: To enter, go to www.bajaorbustsweepstakes.com. Submission will result in one (1) entry. There is a limit of one (1) entry per person. Subsequent entries will be void. Any entries attempted through the use of agencies or robotic, repetitive, automatic, programmed, or similar methods will also be void.

6. Drawings: Winners will be selected sometime between October 2nd, 2007 and October 10th, 2007 in a random drawing of entries received during the Entry Period. The odds of being selected depend on the number of eligible entries received. The Sponsor will attempt to notify the potential winner(s) within 24 hours of the drawing. If the potential winner is unable or unwilling to accept the award, the prize will go to the next eligible potential winner. Any prize(s) unclaimed after 48 hours will be given to a second winner via a random drawing of remaining entries. The potential winner does not need to be present to win. Sponsors’ decision is final and binding on all matters.

7. Requirements of Potential Winners: Except where prohibited, the potential winners will be required to complete and return an affidavit of eligibility and liability/publicity release (the “Affidavit/Release”) within seven (7) days of being notified. If a potential winner fails to sign and return the Affidavit/Release within the required time period, an alternate entrant will be selected in his/her place in a random drawing of all entries received.

8. Prizes: The First place winner will receive Accommodations for 2 to Los Cabos Mexico, November 14th-17th, 3 night, 4 day. This includes airfare. (Approximate retail valued $1000). The will be twenty (20) second place winners, each receiving 1 case of Monster Energy Drink (flavor not guaranteed) and a $50 gift certificate to Wahoo’s.(Approximate retail value $50) There will be 20 third place winners, each receiving a Wahoo’s T-shirt and Hat. (Approximate retail value $20) No prize substitutions are allowed except at the Sponsor’s sole discretion. Prizes are not transferable or refundable and must be accepted as awarded. This is a taxable event and all federal, state, and local taxes and expenses related to the receipt of a prize are the responsibilities of the winner. There is a limit one (1) prize per person and/or household.

9. Publicity: Except where prohibited, participation in the Promotion constitutes the entrant’s consent to the Sponsors’ use of his/her name, likeness, biographical information and state of residence for promotional purposes in any media without further payment or consideration.

10. General Conditions: In the event that the operation, security, or administration of the Promotion is impaired in any way for any reason, including, but not limited to fraud, virus, or other technical problem, the Sponsors may, in their sole discretion, either: (a) suspend the Promotion to address the impairment and then resume the Promotion in a manner that best conforms to the spirit of these Official Rules; or (b) award the prize at random from among the eligible entries received up to the time of the impairment. The Sponsors reserve the right in their sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the Promotion or to be acting in violation of these Official Rules or in an unsportsmanlike or disruptive manner. Any attempt by any person to undermine the legitimate operation of the Promotion may be a violation of criminal and civil law, and, should such an attempt be made, the Sponsors reserve the right to seek damages from any such person to the fullest extent permitted by law. The Sponsors’ failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.

11. Release and Limitations of Liability: By participating in the Promotion, entrants agree to release and hold harmless the Sponsors, their related companies, and their respective officers, directors, employees, and agents (the “Released Parties”) from and against any claim or cause of action arising out of participation in the Promotion or receipt or use of any prize, including, but not limited to: (a) unauthorized human intervention in the Promotion; (b) technical errors related to computers, servers, providers, or telephone or network lines; (c) printing errors; (d) lost, late, postage-due, misdirected, or undeliverable mail; (e) errors in the administration of the Promotion or the processing of entries; or (f) injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant’s participation in the Promotion or receipt of any prize. Entrant further agrees that in any cause of action, the Released Parties’ liability will be limited to the cost of entering and participating in the Promotion, and in no event shall the Released Parties be liable for attorney’s fees. Entrant waives the right to claim any damages whatsoever, including, but not limited to, punitive, consequential, direct, or indirect damages.

12. Disputes: Except where prohibited, entrant agrees that any and all disputes, claims, and causes of action arising out of, or connected with, the Promotion or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate court located in the State of California. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, entrant’s rights and obligations, or the rights and obligations of the Sponsor in connection with the Promotion, shall be governed by, and construed in accordance with, the laws of the State of California, without giving effect to any choice of law or conflict of law rules (whether of the State of California or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of California.

13. Official Rules and Promotion Results: A copy of these Official Rules will be available on the sweepstakes promotional website, www.bajaorbustsweepstakes.com. The winners will be posted on the website, no later than October 10th, staying available online through November 19th.
